  • Content you upload or process: files, media, metadata, rights/contract information, and other information you choose to submit through the platform

  • Log and security data: authentication logs, audit logs, error reports, security events

6. When we act as controller vs processor

Controller: We are the controller for personal data relating to our website visitors, prospects, customers' account administration, billing, and our own marketing.

Processor: When you upload or process content through Whispera AI that contains personal data, we typically act as a processor on your behalf (and you are the controller). In those cases, our processing is governed by our customer agreement and any data processing addendum (DPA) in place.

7. Data Processing Addendum

If you use Whispera AI to process personal data as part of your business activities, you may be required to enter into a Data Processing Addendum (DPA) with us.

Our DPA (where applicable) sets out:

  • The subject matter and duration of processing
  • The nature and purpose of processing
  • The types of personal data and categories of data subjects
  • Our obligations as a processor (including confidentiality, security measures, sub-processor controls, and assistance with data subject requests)
  • International transfer safeguards (where relevant)

8. Sharing your personal data

We do not sell your personal data.

We may share personal data with:

  • Service providers (processors) who help us run our business (e.g., hosting, cloud infrastructure, analytics, customer support tooling, security monitoring, payment processing). They are permitted to process personal data only under our instructions and subject to confidentiality and security obligations.
  • Professional advisers (e.g., lawyers, accountants, insurers) where necessary.
  • Authorities and regulators where required by law or to protect rights, safety, and security.
